Taking Steps to Ensure Safety

Every year, thousands of consumers sustain serious injuries from defective products. Many injuries could have been avoided if manufacturers or distributors took additional steps to ensure consumer safety.

A defective product is one that is unreasonably dangerous for its intended use.

Individuals injured because of a defective product may be able to receive compensation from the manufacturer, wholesaler, retailer or even the maker of a component part. Punitive damages may be available to punish defendants in cases where conduct shows reckless disregard for public safety.

A manufacturing defect occurs when the finished product does not conform to the manufacturer's plans or specifications, such as when a new car malfunctions and causes an accident. A design-defect occurs when a manufactured product is unreasonably dangerous. A child's car seat that provides little or no protection in a side-impact collision could be considered to have a defective design, since a large percentage of collisions are side-impact.
