California is the most populous state in the U.S. and the third largest in terms of size. If it were a separate country, California would have the 6th largest economy in the world, something that residents are known to joke about often. Home of some of the highest profile cases in world, from the OJ Simpson trials to the litigation surrounding Michael Jackson, practicing law in California is not without its excitement. As of 2010, California had an estimated population of 37,253,956 and had a total of 1,235,421 civil incoming cases. This is 3,308 cases per 100,000 of the total population. Of the total civil cases, 57,833 are tort cases, tried in the Superior court. The tort trend in California seems to be on the decline after a spike in 2002.One famous tort case happened in 1969 when Prosenjit Poddar was tried for the murder of Tatiana Tarasoff. Tarasoff’s parents claimed that Poddar had confided his intention to kill Tarasoff two months earlier to Dr. Lawrence Moore, a psychologist in the University of California, Berkeley. The court ruled in Tarasoff’s favor, holding that therapists owe a legal duty not only to their patients, but to individuals specifically threatened by their patients as well.
Like the rest of the country, in California, a signification portion of civil cases in the state courts are personal injury cases. These claims, also called tort claims, all involve some kind of injury to a person or to property due to the actions of another entity. Many lawsuits fall under this category, including medical malpractice, construction accidents, defective products, and traffic accidents.
