Louisiana officially became a state in 1812, but before that its territory, including 15 other present day states, were controlled by the French. It was purchased from the French in the 1800’s for only 3 cents per acre overnight, and without a single war or loss of a single American life. The Louisiana Purchase opened the way for further expansion towards the Pacific. The Louisiana legal structure has influence from Spanish and French governance and some elements are still maintained to this day. One example is the use of the term “parish,” from the French word “paroisse,” instead of the word “county” for their administrative subdivisions.

Louisiana has an estimated population of 4,601,893 and, in 2010, had a total of 123,462 civil incoming cases in their District Court. This is 2,717 cases per 100,000 of the total population. In their City and Parish courts, they had 145,035 civil cases, which is 3,192 cases per 100,000 of the total population.

Like the rest of the country, in Louisiana, a signification portion of civil cases in the state courts are personal injury cases. These claims, also called tort claims, all involve some kind of injury to a person or to property due to the actions of another entity. Many lawsuits fall under this category, including medical malpractice, construction accidents, defective products, and traffic accidents. Traffic accidents generally make up the bulk of personal injury claims, and this is certainly the case in Louisiana.
