Hardaway v. The Place Apartments

On January 6, 2014, Mr. Hardaway was living at an apartment complex on the second floor. He left his apartment around 6:00 am to go to work. As he descended the outside stairway, he suddenly slipped and fell towards the bottom of the steps on ice that had formed on the bottom steps. There had not been any freezing precipitation the night before, although the temperature was well below freezing. It was determined that the sprinkler system for the apartments had been left on and ran for a few hours during the night before. Further, the sprinklers around the stairway were improperly adjusted, and sprayed water over the bottom of the stairs and adjacent walkways. As such, ice formed on the bottom steps of the stairs.

As a result of the fall, Mr. Hardaway suffered a fractured back, which resulted in partial paraplegia. Mr. Hardaway’s ability to walk and perform many of the tasks of daily living was severely impaired. He faces a lifetime of permanent disability.

Michael Guajardo was able to settle the claims a few days before trial for a seven figure amount.
