South Dakota Personal Injury Resources

South Dakota is a state located in the Midwest region of the United States. Just like North Dakota, it is named after the Lakota and Dakota Sioux tribes. The area has been inhabited for several millennia, the Sioux being the most prominent until the late 19th century when the European-American settlers grew in numbers. The settlers intensified after the gold rush and when railroads were constructed in the east. There is a limited amount of time to file personal injury claims in South Dakota. The state has adopted the “discover” rule, which means that the statute of limitation begins when a plaintiff discovers that a claim may have existed. South Dakota’s statute of limitations laws do differ from those of other states.

South Dakota has an estimated population of 833,354 and, in 2010, had a total of 60,091 civil incoming cases. This is 7,360 cases per 100,000 of the total population. The state is notorious for its very lax gun laws, not requiring a permit to purchase both handguns and long guns.

Like the rest of the country, in South Dakota, a signification portion of civil cases in the state courts are personal injury cases. These claims, also called tort claims, all involve some kind of injury to a person or to property due to the actions of another entity. Many lawsuits fall under this category, including medical malpractice, construction accidents, defective products, and traffic accidents. Traffic accidents generally make up the bulk of personal injury claims, and this is certainly the case in South Dakota.
