Utah derived its name from the Ute Tribe, which means “people of the mountains.” About 80% of the population lives around Salt Lake City, leaving the vast expanses of the state nearly uninhabited. It is the most religiously homogenous state as 63% of Utahans are members of the Church of Latter Day Saints. Utah has a special personal injury system for car accidents, called no-fault insurance. It requires purchasing personal insurance protection. Under this system, drivers are reimbursed for their injuries by their insurance companies whether they are at fault or not.

Utah has an estimated population of 2,855,287 and, in 2010, had a total of 145,423 civil incoming cases. This is 5,238 cases per 100,000 of the total population. Of the total civil cases, 2,186 are tort cases, tried in the District court. The tort trend in Utah seems to fluctuate, with a large spike in 2004.

Like the rest of the country, in Utah, a signification portion of civil cases in the state courts are personal injury cases. These claims, also called tort claims, all involve some kind of injury to a person or to property due to the actions of another entity. Many lawsuits fall under this category, including medical malpractice, construction accidents, defective products, and traffic accidents. Traffic accidents generally make up the bulk of personal injury claims, and this is certainly the case in Utah.
