Montreal: The passenger was traveling with her husband to visit her ailing mother. While Mrs. Robles was in the airplane restroom, the aircraft encountered severe turbulence. A loudspeaker ordered all passengers to return to their seats immediately, which startled Robles. She rushed to her seat, and was thrown to the aisle floor. Robles screamed for help and was eventually helped to her seat by flight attendants. A nurse on board rendered aid and realized that Robles had a broken leg. As the plane landed, Robles was helped from the plane by emergency workers, but wasn’t even disembarked first before other passengers. She was sent to one hospital for x-rays and a cast, then transferred two hours later to a different hospital where she had additional tests and surgery.
Mrs. Robles was formerly a dance instructor and was currently a partner with her husband in a physically demanding home improvement business. After the accident, she was completely dependent on her husband to help her with daily tasks. She underwent several courses of physical therapy and was told she may have to walk with a cane for the rest of her life. The incident and the way that she was treated while on board the airplane left her with anxiety and depression.
Slack Davis Sanger negotiated a settlement for Mrs. Robles under the Montreal Convention which helped pay for her past and future medical bills, pain, suffering, and loss.
