Expert Reports Under 4590i
One of the most significant changes to citizens’ rights in the past decade is the 2003 medical malpractice law enacted by the Texas Legislature and signed into law by Governor Perry. These sweeping changes eradicated “Article 4590i” of the Texas Revised Civil Statutes and replaced it with “Chapter 74″ of the Texas Civil Practices and remedies Code. These changes, without exception, limit the rights of citizens affected by bad medical and hospital care, and enhance the profits of the insurance companies that support corporate medicine. There are some statutory similarities between Article 4590i and Chapter 74, so the cases construing Art. 4590i have carried forward until now in Ms. Sweeney’s annual survey paper on the law of medical malpractice in Texas. However, with the passage of time, those cases dealing only with the expert report requirement of Art. 4590i are probably finally obsolete, but are retained here for historical purposes and for those few litigants who either still have 4590i cases or who are involved in cases with similar questions.
